Rental Car Agreement

1.1 "Vehicle" refers to any motor vehicle rented under this Agreement, including all accessories, tires, tools, and equipment.

1.2 "Rental Day" refers to a 24-hour period beginning at the time the Vehicle is released to Lessee.

1.3 "Authorized Driver" refers to any person listed on this Agreement and approved by Lessor to operate the Vehicle.

1.4 "GPS System" refers to any telematics or tracking system installed in the Vehicle to monitor location, speed, and usage.

1.5 "Full Coverage Insurance" includes liability, collision, and comprehensive coverage required by Florida law.

2.1 Lessor agrees to rent to Lessee the vehicle(s) listed in Attachment A ("Vehicle"), subject to availability and all terms of this Agreement.

2.2 Lessee acknowledges that additional vehicles may be added at the discretion of Lessor.

2.3 Vehicle specifications, including make, model, year, VIN, and condition, shall be recorded and attached to this Agreement.

2.4 Lessee shall inspect the Vehicle prior to accepting it and acknowledge any pre-existing damage or mechanical issues.

3.1 The rental period shall be for a minimum of 24 hours per Rental Day.

3.2 Short-term rentals: payment is due at the end of the rental period.

3.3 Long-term rentals exceeding 7 days: payment will be automatically charged every Friday for the preceding week.

3.4 Extensions of the rental period require written approval from Lessor and may result in additional charges.

3.5 Lessor reserves the right to refuse rental extensions or renewals at its discretion.

4.1 Weekly Rental Fee: as shown for the selected Vehicle at booking.

4.2 Credit Card Requirement: Lessee must provide a valid credit card on file. If no credit card is available, a refundable deposit of $250 will be required.

4.3 Late Payment: If payment is not received within 24 hours of the due date, the Vehicle may be remotely disabled until payment is made.

4.4 Lessee is responsible for all fees incurred for tolls, traffic citations, or parking violations during the rental period.

4.5 Additional fees for mileage overage, late returns, or special services are outlined in Attachment D.

4.6 Taxes, surcharges, and applicable regulatory fees shall be added to all rental charges.

5.1 Lessee may not operate the Vehicle beyond 200 miles from 4357 Okeechobee Blvd. Ste C5, West Palm Beach, FL 33409.

5.2 The Vehicle is equipped with GPS tracking. If the Vehicle exceeds this limit, it may be remotely disabled.

5.3 Any mileage exceeding the approved limit may incur additional charges as specified in Attachment D.

5.4 Lessee shall not remove, tamper with, or disable any GPS or telematics devices.

6.1 Lessee must maintain Full Coverage Insurance including: (a) liability coverage as required by Florida law; (b) collision coverage; (c) comprehensive coverage.

6.2 Proof of insurance must be provided prior to the Vehicle being released.

6.3 Lessee shall provide immediate notice of any claims, accidents, or damages to their insurer and Lessor.

6.4 Lessor may require additional coverage or verification depending on Vehicle type or rental term.

6.5 Lessee waives any right to claim Lessor's insurance for damages caused by Lessee's negligence. If the Lessee does not have insurance, Lessor can provide PIP insurance for $50 weekly.

7.1 Vehicle shall be used solely for lawful purposes by licensed drivers.

7.2 Vehicle shall not be used for commercial purposes, towing, racing, off-road driving, or any illegal activity.

7.3 Lessee shall comply with all local, state, and federal laws while operating the Vehicle.

7.4 Lessee shall not allow unauthorized drivers to operate the Vehicle.

7.5 Lessee shall not transport hazardous materials or engage in any activity that may damage the Vehicle.

7.6 Lessee shall not modify, alter, or remove any equipment, safety device, or signage from the Vehicle.

8.1 Lessee is responsible for any damage caused to the Vehicle during the rental period.

8.2 Lessee must report any damage, accident, or mechanical failure immediately.

8.3 Lessor shall perform routine maintenance prior to each rental. Lessee shall notify Lessor of any maintenance issues.

8.4 Lessee shall bear costs for repairs caused by misuse or negligence.

8.5 Lessor may charge for towing, storage, or labor if Vehicle is disabled due to Lessee's actions.

8.6 Lessee shall not attempt repairs or maintenance without Lessor's authorization.

9.1 Lessee shall return the Vehicle in the same condition it was received, including cleanliness and fuel level.

9.2 Late returns may incur additional charges at the daily rental rate.

9.3 Lessor reserves the right to inspect the Vehicle upon return and assess damages, missing equipment, or excessive cleaning requirements.

9.4 Early returns do not exempt Lessee from payment obligations for the agreed rental period.

10.1 Lessor may terminate this Agreement immediately if Lessee violates any terms.

10.2 Upon termination, Lessee must immediately return the Vehicle or it may be remotely disabled and repossessed.

10.3 Fees incurred due to early termination will be charged to the credit card on file.

10.4 Lessee shall cooperate with Lessor in case of repossession or termination.

10.5 Termination does not waive Lessor's right to seek damages or fees.

11.1 Lessee agrees to indemnify and hold harmless Lessor from any liability, damages, claims, or expenses arising from use of the Vehicle.

11.2 Lessor is not responsible for personal property left in the Vehicle.

11.3 Lessee assumes all risk associated with Vehicle operation and agrees to follow safety precautions.

11.4 Lessor is not liable for delays, interruptions, or loss of use caused by mechanical issues, accidents, or natural events.

12.1 Lessor shall not be liable for any failure to perform due to causes beyond its reasonable control, including natural disasters, accidents, acts of God, civil unrest, or government actions.

12.2 Lessee acknowledges that rental obligations remain in effect despite force majeure events unless terminated by mutual agreement.

13.1 Any disputes arising under this Agreement shall first be addressed through informal negotiation.

13.2 If unresolved, disputes shall be submitted to binding arbitration in Palm Beach County, Florida, under the rules of the American Arbitration Association.

13.3 Arbitration decisions shall be final and enforceable in a court of competent jurisdiction.

14.1 GPS data may be collected and used to ensure compliance with mileage and location restrictions.

14.2 Lessor will not share Lessee's personal data except as required by law or for enforcement of this Agreement.

14.3 Lessee consents to the use of GPS tracking and telematics data during the rental period.

15.1 Lessee warrants they hold a valid driver's license and are legally eligible to operate a motor vehicle in Florida.

15.2 Lessee warrants the accuracy of information provided in this Agreement and attachments.

15.3 Lessee warrants they have adequate insurance coverage as required herein.

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved in the appropriate court of Palm Beach County.

This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements, oral or written.

If any provision of this Agreement is found invalid or unenforceable, remaining provisions remain in full force and effect.

Lessee acknowledges that they have read and understand this Agreement and agree to be bound by its terms.
